Welcome to the Courts Service Portal ("Portal"). The Portal is owned and operated by the Courts Service as established under the Courts Service Act 1998 (“Courts Service”).

Definitions

Digital Court Rules
means the Rules of the Superior Courts (Digital) 2024 and the Rules of the Circuit Court (Digital) 2024.

Portal
means the online system provided by the Courts Service for digital submission, management, and tracking of court filings and applications, referred to under the name of the Courts Service Portal. The Portal is the “network” as provided for under the Digital Court Rules. No other network or system, regardless of who owns and operates it, constitutes the “network” under the Digital Court Rules.

Digital User
is as defined by the Digital Court Rules.

Statement of Truth
is as defined under the Digital Courts Rules

Acceptance of Terms
These Terms and Conditions (“Terms”) govern the use of the Portal and are provided for under the Digital Court Rules. You should read these Terms carefully before using the Portal. All access to and use of this Portal or the information on it, is subject to these Terms. If you continue to access the Portal, you are deemed to have accepted and be bound by these Terms.

User Account

Any use of the Portal means that you are deemed to be a Digital User under the Digital Court Rules.

Being a digital user means that:

You consent to digital service through the network of all documents that are served upon you digitally through the network

If you represent other parties and have the authority to accept service on behalf of those parties, you consent to service on behalf of the said parties digitally through the network

You are responsible for keeping your contact details up to date on the Portal. Accordingly, the Courts Service, to the fullest extent permitted under applicable law, disclaim any liability for loss including but not limited to loss of data, income, profit or opportunity and in addition consequential losses or losses resulting from claims of third parties, which are caused by your failure to ensure your contact details are current, accurate and complete

If your user account is an authorised administrator account for your organisation, you agree to disable the user accounts of people who have left your organisation and do this in a timely manner. Failure to do so may expose your organisation’s and your clients’ data to unauthorised parties. The Courts Service will not be liable for such exposure or any consequences resulting from it.

You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any actual or suspected unauthorized use of your account.

You can disable your user account at any time. This means you cease to be a Digital User. You will not be able to access the Portal, or the digital information contained within it via the Portal.

Communications from the Portal

The Courts Service will not be held liable for any losses, damages, or claims arising from communications that were not received, read, or acted upon due to technical failures within the Portal and/or supporting services or user error. This includes but is not limited to emails, notifications, messages or any other forms of communication facilitated through or by the Portal.

Users of the Portal acknowledge that technical issues, including but not limited to service outages, software bugs or internet connectivity problems, may occur and may result in delayed, lost or undelivered communications.

Furthermore, the Courts Service cannot guarantee that users will receive or read all communications in a timely manner, or at all. Users are responsible for regularly checking their accounts and ensuring their contact information is up to date to mitigate any potential communication issues.

Use of the Portal

You agree to use the Portal only for lawful purposes and in accordance with these Terms. You shall not knowingly use the Portal in any way that could damage, disable, overburden, or impair its functionality

If you engage in misuse or unlawful use of the Portal, the Courts Service may withdraw your permission to use the Portal or bring such use to the attention of the relevant court.

Use of the internet and the Portal is at your own risk, and the Courts Service is not responsible for losses resulting from the use of, or from an inability to use, the Portal. Accordingly, the Courts Service, to the fullest extent permitted under applicable law, disclaim any liability for loss including but not limited to loss of data, income, profit or opportunity and in addition consequential losses or losses resulting from claims of third parties. Such losses include but are not limited to losses caused by viruses or bugs, defects in the Portal, interference by an unauthorised third party, fraud or theft, technical failure, deletions or delays.

Retention of Documents

Under the Digital Court Rules exhibits to a Statement of Truth, if uploaded to the Portal, shall be retained for a minimum period of 90 days, after which the Portal may automatically delete such uploads without notice.

It is the responsibility of Digital Users to make and/or keep copies of all documents uploaded to, or issued by the courts via, the Portal within 90 days as necessary.

Privacy Policy
Use of the Portal, in particular exercising your rights under data protection laws, is governed by the Courts Service’s Privacy Policy which can be found on the Courts Service website, courts.ie.

Limitation of Liability
In no event shall the Courts Service be liable for any damages arising out of, or in connection with, your use of the Portal. This includes, but is not limited to, direct, indirect, incidental, and consequential damages.

Changes to Terms
The Courts Service reserves the right to modify or update any materials or information on the Portal, including these Terms, at any time without prior notice. You will be notified when the Terms change. Continued use of the Portal following any changes indicates your acceptance of the new Terms.

Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ireland.
